Security and Access to Data

Huzizit undertakes to store members information in a secure manner consistent with allowing item searches using the Internet, and to preserve this information for as long as the member has paid a subscription fee. Information may be stored in excess of this period but may not be accessible to members or to the public.

Huzizit may use such archival technology as may preclude the deletion of particular data which has been archived. Such data is not accessible to members or to the public.

Huzizit will endeavour to provide a continuous service to members and to preserve their information in a secure manner, for example by using secure server technology, encrypted databases and redundant archives, and shall take reasonable steps to ensure that members information is restored in the event of system failure. However, circumstances beyond Huzizits control, such as but not limited to network failure, power failure, fire, flood, sabotage or unauthorized access to computer systems, may render the service temporarily or permanently unavailable. Huzizits liability in such case shall be limited to the monies paid by members for the service, pro-rated in proportion to the time that the service was unavailable. In particular, Huzizit is not responsible for any item registered with the service where, as a result of problems, technical or otherwise, with the service it is not possible to correctly identify the owner.

Huzizit may, in the event that technical or other difficulties prevent Huzizit from providing service, cancel a members subscription and refund the members fee. Such refund may be pro-rated for the fraction of membership remaining.

Huzizit shall take reasonable steps to ensure that members contact information such as email addresses and telephone numbers is held in a secure manner and is not accessible to other members or to members of the public. However, the nature of the service requires that this information be held on a computer connected to the public Internet and from time to time methods may be discovered whereby persons may gain unauthorized access to such information. Huzuzit will take reasonable steps to ensure that such access is detected and blocked in an expeditious manner. Huzizits liability in such case shall be limited to the monies paid by members for the service. Huzizit shall not be liable for direct or consequential damages incurred as a result of theft of members information normally kept hidden.

Use of Identification

Identification of an item using the Huzizit service shall not be taken as proof of ownership. Members should keep normal records and receipts for valuable items registered with the service.

Although Huzizit recommends that the Huzizit item code be engraved on items in order to aid identification, Huzizit is not responsible for any diminution in value that may occur as a result of such engraving, etching or marking.

Abuse of Service

Members are prohibited from using the Huzizit service to promote services or products, by means such as manipulating contact addresses in order to send email, fax or telephone messages to distribution lists.
They are required, when promoting the Huzizit service in order to earn referral points, to abide by the regulations and code of conduct of any media used in such promotion, including, but not limited to, chat rooms, Usenet discussion groups and mailing lists. They are prohibited from using unsolicited bulk email for this purpose.
While, in the short term, Huzizit may benefit from such promotion, it would be injurious to Huzizit.com to be listed by any real-time blocking service as the beneficiary of unsolicited bulk email.

Members are prohibited from using the service in order to obtain ownership of items to which they have no legal entitlement.
They are prohibited from accessing member information by means other than the advertised service (for example, by unauthorized access to Huzizits computers, networks or backup media).

Penalties

Huzizit may cancel the membership of any member who breaches these conditions, with no refund of any monies. In the event of egregious abuse, Huzizit reserves the right to disclose members information and network logs to appropriate authorities.

Cancellation of Service

Members may at any time cancel their membership with Huzizit. Huzizit will in such case remove the members contact information from the current database subject to verification of identity. Huzizit will not normally refund any monies for the current membership interval (normally one year), unless Huzizit has been unable to provide the service for technical or other reasons.
